King Van Nest isn’t like other law firms. While many attorneys work on volume, King Van Nest handles no more than five carefully curated, high-impact cases at any one time. This enables the firm to focus intensely on a small number of complex matters, deploying a unique approach in the service of a relentless pursuit of justice for people who have been harmed.

Victory at Trial Begins with Trust

King Van Nest employs a three-phase approach to identify cases and prepare them for trial.

Phase 1 — The Intelligence Cycle

King Van Nest uses a systematic method to research and identify high-impact cases within discrete business sectors. Working with researchers, big data analytics, artificial intelligence, journalists, and others, the firm identifies wrongdoers and dives deep into their history, gathering evidence of systemic abuse and developing a bespoke strategy to identify people and families most likely to have suffered the greatest harm. The firm cultivates trust relationships to continue gathering the information necessary to prepare a lawsuit. Our strategy is inspired by the Intelligence Cycle which consists of the following six steps.

Requirements

The firm determines the direction of several strategic litigation strands each year which in turn drives the issues that need to be addressed and sets overall priorities. Resources and all-source collection activities are focused on the highest priority strands to meet the identified requirements.

Planning

Once the requirements have been established, a plan is developed to specify the types of information needed and the most effective methods for collecting it.

Collection

The firm uses many methods to collect information, including face-to-face meetings with people who have unique knowledge of a wrongdoer’s activities, big data analytics, open source intelligence developed from a host of publicly available resources, and carefully curated artificial intelligence platforms. Information collected must be relevant, timely, and useful. At this stage, the information collected is considered raw intelligence because it has not been thoroughly examined and evaluated yet.

Processing

The processing stage of the intelligence cycle can yield large amounts of data that requires organization and refinement. Substantial resources are devoted to synthesizing this data into a form that intelligence analysts and researchers can use.

Analysis

Analysts examine and evaluate all the information collected, add context as needed, and integrate it into complete products. They produce finished intelligence that includes assessments of events and judgments about the implications of the information for the attorneys involved in each case.

Dissemination

Finished intelligence is delivered to attorneys and clients who then make decisions based on the information. Finished intelligence can lead to requests for additional information, thus triggering the intelligence cycle again.

King Van Nest Does Things Differently

A graduate of the University of Wisconsin Law School, Jeffrey K. Van Nest served in the Navy Judge Advocate General (JAG) Corps, where he was first introduced to intensive psychodrama enabled trial advocacy created by Gerry Spence’s Trial Lawyers’ College. Jeff spent the next two decades serving his country in the FBI as a Special Agent and Chief Division Counsel. Jeff later returned to the Trial Lawyers’ College where he had learned so much early in his career. Jeff’s experiences with the Trial Lawyers College methodology was transformative and now shapes his identity as a trial attorney, empowering him to advocate for people who were harmed by the greed of large, faceless corporations who value profits over people.

A Powerful Advocate for People Who Have Been Ignored or Overlooked

Jeff’s approach is truly one-of-a-kind. Using the Intelligence Cycle, Enterprise Theory, and the skills he honed through the Trial Lawyer’s College, he assembles and leads cross-functional teams to achieve outstanding results. Jeff quickly identifies the key facts of a case and then uses psychodrama techniques to develop a deep understanding of its emotional resonance that allows him to connect fully with clients, witnesses, judges, and jurors to obtain outstanding results for each client

A member of a dedicated group of TLC graduates — known as the F Warriors — Jeff and his nationwide network of colleagues are true champions of justice, protecting people against corporate greed and wrongdoing.
